  1. Acceptance of Terms

    1. These Terms of Use apply to www.co.clark.wi.us website managed by Clark County (“Site”). Please read these terms carefully before using the Site. By accessing and using the Site, you are agreeing to the terms and conditions described herein. Clark County reserves the right to update these terms at any time without prior notice.

  2. Disclaimer

    1. Users of the Site agree to indemnify, hold harmless, and defend Clark County, its employees, officials, agents, and governing bodies (“Clark County”) from any and all lawsuits, claims, demands, liabilities, losses and expenses, including court costs, attorneys' fees, and other expenses relating to or on account of any damages or injury, including but not limited to those caused by any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, communication line failure, theft or destruction or unauthorized access to, accessibility to external sites, alteration of or use of record, whether for breach of contract, tortious behavior, negligence or under any other cause of action, associated with, directly or indirectly, any use or access of the Site or the information contained herein.

    2. Users agree to use or access the Site at their own risk, “as is”, and “as available”. Clark County does not provide warranty of any kind, expressed or implied, as to the accuracy, adequacy, completeness, timeliness, legality, reliability, or usefulness of any information on the Site. Warranties of any kind, expressed or implied, include, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, freedom from contamination by computer viruses and noninfringement of proprietary rights are disclaimed by Clark County.

  3. Obligations

    1. When using Site, you agree to provide true, accurate, current/up-to-date, and complete information when prompted. You are solely responsible for all content (i.e. information, data, text, software, music, sound, photographs, graphics, video, messages, or other media) you upload, post, provide, email, distribute, or otherwise transmit.

    2. You are prohibited from posting or transmitting any unlawful, threatening, libelous, defamatory, obscene, inflammatory, or any other unprotected material that may be deemed unlawful. Clark County reserves the right to remove such material and any content that may violate these Terms of Use without prior notice.

    3. Clark County does not guarantee the accuracy, integrity, or quality of content posted or transmitted by others. Clark County is under no obligation to monitor or review discussions, chats, postings, transmissions, bulletin boards, or any other communication from third parties.

  4. Account Password and Security

    1. Certain fee-based services may require an account (i.e. username and password). Unless otherwise noted, accounts are not transferable between users. You are responsible for maintaining the confidentiality of the account and the account’s registered owner is fully responsible for all activities that occur under the account. You agree to:

      1. Immediately contact Clark County of any unauthorized use of your account or any other breach of security;

      2. Ensure that you log-off from your account at the end of each session; and

      3. Indemnify, hold harmless, and defend Clark County for any and all claims of loss or damage arising from your failure to comply with this section.

  5. Privacy

    1. Clark County acknowledges your trust and is committed to protecting the information collected and/or submitted on the Site. To prevent unauthorized access, maintain accuracy, and ensure proper use of information, Clark County has implemented safeguards to secure the information obtained from the Site.

    2. The information collected and/or submitted on the Site includes personally identifiable information and non-personally identifiable information.

      1. Personally identifiable information provides specifics about you (i.e. name, address, phone number, email address, credit card information, etc.). Such information may be requested and provided through service requests, surveys, job applications, and/or other correspondents with Clark County or third-party applications. Such information is used to process user’s requests and/or provide requested services or information.

      2. Non-personally identifiable information does not identify specific individuals. Such information may include, but is not limited to, the Uniform Resource Locator (URL1) of the pages you visit on the Site and Internet Protocol (IP2) address. Non-personally identifiable information is collected and analyzed on an aggregated basis to help understand how visitors use the Site, to measure interest in the Site’s pages, and to improve the content and accessibility of the Site.

    3. State of Wisconsin laws exist to ensure that government is open and that the public has a right to access appropriate records created and/or maintained by government. Information collected and/or provided may be subject to inspection and copying by the public. However, there are exceptions to the public's right to access public records provided by both state and federal laws. These exceptions include protecting the privacy of individuals. Clark County may disclose information to other companies, agencies, or people to provide products or services requested or as required by law, subpoena, court order, or legal process.

  6. Accessibility

    1. Clark County is committed to developing and maintaining the Site so that the Site is accessible to persons with all types of abilities. Each individual using the Site has the right to obtain information independently and conveniently.

    2. If you use assistive technology (such as a Braille reader, a screen reader, or TTY) and the format of any material on the Site interferes with your ability to access information, please contact us and indicate the nature of your accessibility problem, the preferred format in which to receive the material, the Site address of the requested material, and your contact information.

    3. The Site contains links to PDF documents that require the most current version of Adobe Reader to view. The Adobe Acrobat Reader may already be installed on your computer as a "plug-in" or "helper application" for your web browser. To find out, click on the "PDF" link for the document you are interested in. If the Adobe Acrobat Reader is properly installed on your computer, the Reader will either download or automatically open a PDF copy of the document, depending on your browser and how it is configured. If the Adobe Acrobat Reader is not installed on your computer, it can be found at the Adobe Acrobat Reader download page.

  7. Intellectual Property

    1. The material on the Site is for the non-commercial use of the general public. The fair use guidelines of the U.S. copyright statutes apply to all material, information, and data on the Site. Clark County shall remain the sole and exclusive owner of all rights, title, and interest in and to all copyrighted information created and posted on the Site. For copy or use of information on the Site that is outside of the fair use provisions of copyright law, the user shall request permission from Clark County.   8. External Websites and References

    1. The Site has links, for informational purposes only, to other websites. These links may include links to websites operated by other government agencies, nonprofit organizations, private businesses, and/or individuals. When you access a website through a link on the Site, you are no longer on the Site and not subject to these Terms of Use and are subject to the external website’s policies.

    2. Clark County is not responsible for the content from or on external sites. Clark County is not liable for the defamatory, offensive, or illegal conduct of other users, links, or third parties. The risk of injury and/or damage from the foregoing rests entirely with the user.

    3. Unless otherwise expressed, any reference made by the Site to any specific commercial product, process, or service by trade name, trademark, hyperlink, or otherwise does not constitute, expressed or implied, an endorsement, recommendation, or favoring by Clark County. Any opinions, advice, statements, services, offers, or other information expressed or made available by third parties on or through the Site are those of the perspectives of the third party and not Clark County.

  9. Termination

    1. Clark County reserves the right to modify or discontinue, temporarily or permanently, the Site with or without prior notice for any reason. You agree that Clark County shall not be liable for any modification, suspension, or discontinuance of the Site.

  10. Choice of Law

    1. These Terms of Use are governed by the laws of the State of Wisconsin. The laws of the State of Wisconsin, U.S.A., shall apply to all access and uses of this Site. By use of this Site, the user agrees that use shall conform to all applicable laws and regulations and user shall not violate the rights of Clark County or any third parties. You and Clark County agree to submit to the personal and exclusive jurisdiction of the State of Wisconsin for any disputes or claims arising out of Site use.

  12. General Information

    1. This constitutes the entire agreement between the user and Clark County regarding use of the Site. The failure of Clark County in exercising or enforcing any rights or provisions of the Terms of Use shall not constitute a waiver of such right or provision. By accessing and using the Site, you may also be subject to additional terms that may apply when you use affiliate services, third-party content, or third-party software.
